By clicking “Register” or proceeding with onboarding on The Experience Store (“Marketplace”) platform, you (“Vendor”) agree to be legally bound by the following Terms and Conditions. If you do not agree, please do not proceed with registration.
Vendors must provide truthful, accurate, complete, and up-to-date registration information at all times. The Marketplace reserves the right to verify or audit the Vendor’s credentials, background, and service capacity before or after approval. Approval of registration is at the sole discretion of the Marketplace and may be denied, suspended or revoked at any time, for non-compliance, inaccuracy, or reputational risk. The Vendor shall be fully liable for any damages, loss, or misrepresentation resulting from false or misleading information submitted during registration.
The Vendor agrees not to directly or indirectly solicit, initiate contact with, or engage with any clients, partners, leads, or affiliates introduced by the Marketplace without prior written consent, either during the engagement or for 24 months after termination, expiration or suspension. Any attempt to bypass, circumvent, or disintermediate the Marketplace’s role shall constitute a material breach, subject to immediate delisting, liability for damages, and entitlement of the Marketplace to injunctive relief and legal costs.
The Vendor agrees not to share, replicate, or disclose any Marketplace-curated experiences, client data, bundles, pricing strategies, or service frameworks with any competitor or third party during and after the term of engagement, and thereafter for five (5) years and extends to the Vendor’s employees, agents, contractors, and affiliates. Any breach of this clause shall be considered a material breach, entitling the Marketplace to immediate suspension, injunctive relief, and recovery of damages, including legal fees.
The Vendor grants the Marketplace a non-exclusive, royalty-free revocable license to use its brand name, logo, service images, and content for marketing, display, and promotional purposes across the platform, social media, and related campaigns. Use of branding does not transfer ownership, and Vendors may revoke usage rights with 30 days’ notice unless materials are already committed to ongoing campaigns. The Vendor warrants that it has full rights to license these materials and shall indemnify the Marketplace against any third-party IP claims related to their use.
Upon registration, Vendors agree to comply with all service-level expectations, operational standards, response times, fulfillment standards, and customer service guidelines defined by the Marketplace. Repeated complaints, service failures, or policy breaches may result in suspension or delisting without notice. The Vendor shall be liable for any damages, refunds, or losses incurred by the Marketplace as a result of service deficiencies, including harm to user trust, client relationships, or brand reputation.
The Vendor agrees to defend, indemnify and hold harmless the Marketplace, its affiliates, officers, and agents from any claims, damages, liabilities, or expenses (including reasonable legal fees) arising out of:
This indemnity obligation shall survive termination of the Vendor’s registration or account.
The Marketplace shall not be liable for any indirect, incidental, special, punitive, or consequential damages including but not limited to loss of revenue, profits, goodwill, or data, arising out of or in connection with the Vendor’s registration, services, or use of the platform. All services and listings are provided “as-is” and “as-available” basis, without warranties, express or implied, and the Marketplace does not guarantee lead volume, client conversion, or business success.
Vendors are fully responsible for the safety and legality of any wellness, fitness, or therapeutic services offered. The Marketplace is not liable for any injury, illness, or adverse effect resulting from such services. Vendors shall indemnify the Marketplace against related claims.
In case of a dispute, both parties agree to first attempt to resolve through good faith negotiations and discussions. If unresolved, disputes shall be referred to binding arbitration under UAE law, with the seat in Dubai, and proceedings conducted in English.
The Marketplace reserves the right to suspend or terminate any Vendor account at any time with or without prior notice, for reasons including (but not limited to) violation of these terms, reputational harm to the Marketplace, service failures, customer complaints, or operational disruption. The Marketplace shall have no liability to the Vendor for any resulting loss, including lost business or opportunities.
These Terms may be updated, amended, or modified from time to time. Continued use of the platform constitutes acceptance of the revised Terms. Vendors are solely responsible for reviewing the Terms periodically to stay informed of their rights and obligations.
These Terms are governed by the laws of the United Arab Emirates. Vendors are solely responsible for complying with all applicable laws, regulations, permits, and licenses required to offer their services. The Marketplace shall not be liable for any non-compliance.
By registering as a vendor, you confirm that you have read, understood, and accepted these Terms and Conditions in full and you agree to be legally bound by these Terms and Conditions.
